01 Employee Tax Refunds - the Basics
Salaried employees pay income tax through withholding: the employer deducts tax each month on the payslip, based on an estimate of annual income. If at year's end it turns out more tax was withheld than the statutory tax - the difference is "excess tax", and the state refunds it with indexation differentials and 4% annual interest. The right is anchored in Sections 159A-160A of the Income Tax Ordinance.
The monthly withholding is based on estimated income and on the data the employer knows at that moment. When something changes during the year - a birth, layoff, a donation, an independent pension deposit or a job change - the monthly calculation is not always updated, and a gap in your favor appears, revealed only in the annual calculation.
Any individual who overpaid income tax: salaried employees, pensioners, and in certain cases the self-employed as part of the annual report. You do not need to be obligated to file a report - in fact, those not obligated to file submit a refund request on Form 135 or online.
Up to 6 years from the end of the tax year. In 2026, requests can be filed for the years 2020-2025, with a request for 2020 accepted only until 31.12.2026. At the start of each year another year drops out of the window, so it pays to act soon.
Only after the end of the tax year it refers to. In practice most certificates (Form 106, provident fund and bank certificates) arrive around April, which is a convenient time to file. The filing date itself does not matter - the right is preserved until the 6-year window closes.
No. The Authority does not run proactive refund checks for employees; whoever does not file a request simply does not receive the money, and it stays with the state. That is why the review is at your initiative only.
The Tax Authority operates an eligibility simulator for employee tax refunds on gov.il - an anonymous simulation where you enter income data and get an indication of whether a refund exists. If it comes out positive, the full calculation should be verified before filing.
Absolutely. The refund is an explicit legal right in the Income Tax Ordinance, and the Tax Authority itself operates a dedicated online channel for filing requests. Filing a request does not harm your file or increase audit chances.
State Comptroller reports (including Report 66A) found that the state collected excess taxes on the scale of billions of shekels, mainly from employees who did not exercise their rights. That is the figure refund companies quote - and it is also the reason to check, with me or on your own.
02 Eligibility from Family Status and Children
Every Israeli resident is entitled to 2.25 credit points. As of 2026, a credit point is worth 242 NIS per month (2,904 NIS per year). Women are entitled to an additional half point. If these points were not fully reflected in the payslip - a refund is created.
Usually yes. Parenthood grants additional credit points, and if the birth was not updated on Form 101 with the employer, the tax withheld since the start of the year was too high. A retroactive refund can be requested for previous years too, within the 6-year window.
The entitlements vary by the child's age, the number of children and the tax year - the rules were updated several times in recent years. Because of the frequency of changes, employer calculation errors are very common, and this is one of the leading grounds for refunds. The exact calculation is checked for each year separately.
A parent of a child with a disability may be entitled to additional credit points and further reliefs, and in certain circumstances the right continues after the child reaches adulthood. Refunds here can be significant over the years, and it is worth checking the entire 6-year window.
A "single parent" (meeting the law's conditions) is entitled to additional credit points for raising children. A divorced or separated parent who pays child support and raises their children may also be eligible. If the status was not updated with the employer - a refund is created.
Alimony paid to a former spouse may entitle you to credit points or a tax credit, subject to the law's conditions and amounts. Attach the judgment or agreement and payment confirmations to the refund request.
Marriage changes the calculation: someone supporting a non-working spouse is entitled to an additional credit point, and spouses choose who will be the "registered spouse" in the refund request. If the marriage was not reported to the employer, a retroactive refund may exist.
Yes. Someone supporting a spouse with no income is entitled to a credit point for the dependent spouse. If the fact was not recorded on Form 101, the tax you paid during the year was higher than required.
It depends on the ground: a birth certificate or ID appendix for children, a single-status certificate or divorce judgment, an alimony agreement, National Insurance confirmations of single parenthood, and relevant medical certificates for disability-based eligibility. The request includes only what proves the ground.
Responsibility for the tax is yours, but the money is not lost: in the current tax year you can ask the employer to correct the calculation and refund through the payslip (even after leaving the job, as long as the year has not ended). For past years - a refund request is filed with the Tax Authority.
03 Work, Salary and Periods Without Work
When working for two employers without tax coordination, each employer withholds as if it were the only one - sometimes too much, sometimes too little tax. Tax coordination fixes this during the year; if no coordination was done, the annual calculation reveals the gap and the refund comes from the Tax Authority.
This is one of the most common grounds. The monthly withholding assumed you would work all year at the same salary; when employment stops, actual annual income is lower than estimated, and the tax withheld in the working months is higher than the statutory tax - especially when adding credit points for children. The difference is refunded.
Unemployment benefits are taxable, but lower than regular salary. Total annual income (salary + unemployment benefits) is usually lower than the estimate the withholding was based on during the working period, so a refund builds up. National Insurance certificates should be attached to the request.
Yes. Moving between employers commonly causes continuity errors: credit points that did not carry over, income counted twice, or missing tax coordination. Even a gap of a month or two between jobs lowers annual income and may create a refund.
Reserve-duty combatants are entitled to income tax credit points according to their service days, and reserve pay itself counts toward the annual calculation. If the credit was not given on the payslip - it can be received retroactively in the refund.
Discharged soldiers and national-civic service graduates are entitled to credit points in the years following service, according to the service period and the law's conditions. Many young employees are unaware of this, and it is a classic ground for a refund on the first working years.
Just like layoffs: the monthly withholding assumes a full working year at the same level. Part-year or seasonal work lowers actual annual income, and the tax withheld in the working months may exceed the statutory tax - up to a full refund.
At retirement you receive Form 161 (termination of employment), and you should verify the severance pay and exemptions were computed correctly. Pensioners keep paying tax by withholding on the annuity, and refunds are common for them too - credit points, severance spreading and eligibility-age reliefs. Form 161 and the annuity's Form 106s are attached to the request.
An exceptional payment inflates you into a high tax bracket for that month, as if the annual salary were that much higher. If the rest of the year was normal, the annual calculation balances part of the excess. In certain cases annual weighting or backward spreading is relevant - checked case by case.
Partial work months produce low salary in those months, but withholding is set by each employer's local calculation. The sum of all these small gaps over the year is exactly what the annual calculation corrects.
04 Pension, Provident Funds and Insurance
An employee who deposited independently (not through the payslip) into a provident fund for pension savings as a "preferred member" is entitled to a credit of 35% of the deposit, up to the legal ceilings. Because the deposit did not go through the payslip, the credit is not given during the year - it is received only through the refund request. This is one of the most worthwhile grounds.
Premiums paid for life insurance and pension savings may entitle you to a tax credit at the rates and conditions set by law, subject to ceilings. Attach the annual certificates from the insurance companies (they arrive around April) to the refund request.
Pensioners receiving an annuity pay tax by withholding exactly like employees, and mistakes are common for them too: credit points not granted, additional income without tax coordination, or reliefs never exercised. Pensioners not obligated to file a report submit a refund request just like an employee.
Employer contributions to the pension and severance components count in the various credit and exemption tracks. Gaps in contributions change the annual calculation. In addition, a missing contribution is a separate issue with the employer, beyond the tax refund.
Moving between funds within the pension system is not a taxable event in itself, but it is worth verifying that the annual certificates reflect all deposits in all funds. A missing certificate for a fund you moved money out of can cause a missing credit.
A credit reduces the tax payable (for example 35% of the deposit up to the ceiling), while a deduction reduces taxable income. For employees depositing independently, the preferred-member credit track usually fits. The choice between tracks is made in the optimal calculation for each case.
An annual deposit certificate from every provident fund, pension fund or insurance company you paid into, for each requested tax year. The certificates are issued toward April of the following year and mark the deposit amounts that grant entitlement.
05 Donations, Studies, Residence and Special Circumstances
A donation to a public institution approved under Section 46 of the Ordinance entitles a credit of 35% of the donation amount, subject to the legal conditions and ceilings. An employer does not pass this credit through the payslip, so it is received only through the refund request - even retroactively up to 6 years, based on receipts.
An original receipt from the institution marked as approved under Section 46. Many institutions send consolidated annual certificates. Donations to bodies not approved under Section 46 do not entitle a credit.
Graduates of an academic degree are entitled to credit points in the years near graduation (the rules differ between first degree, second degree and professional studies, and change from time to time). Someone who finished studying and worked in those years without the credit being granted on the payslip is entitled to a refund.
New immigrants (olim) are entitled to graduated credit points in the first years after immigration, according to the time elapsed and the law's conditions. Employees who immigrated and did not update their employer are entitled to a retroactive refund on their working years in Israel, within the 6-year window.
Residents of eligible localities (development towns and localities on a government list) are entitled to a tax credit as a percentage of income, according to the locality and the tax year. If the locality was not recorded with the employer or the credit was not granted - a refund is filed with a residency certificate.
A person with a disability recognized by National Insurance or the Income Tax Authority may be entitled to credit points and exemptions, and in certain cases also for a spouse or child with a disability. The reliefs require relevant certificates, and the refunds accumulate into significant amounts over the years.
Under certain conditions, a parent of an adult without legal capacity is entitled to continued tax reliefs. The matter requires an individual review of the certificates and registration, and often involves a significant multi-year refund.
Under certain conditions, yes. Foreign workers are entitled to basic credit points and to certain arrangements, and a non-resident who paid tax in Israel may be entitled to a refund under Israeli law and the tax treaties. Each case is checked by its status.
A deduction for exceptional medical expenses is not available to employees in the regular employee refund track; medical reliefs are given mainly through credit points and disability exemptions. An exceptional case will be checked individually against the Ordinance's provisions.
Severance and grant money is exempt up to certain legal ceilings, and taxable above them (sometimes with forward spreading). If tax was withheld from money that was exempt, or the exemption was not fully exercised - the difference is refunded. Form 161 is attached to the request.
06 How to File a Tax Refund Request
Online: the Tax Authority's system for filing a tax refund request (active since tax year 2019) - identification, opening an online refund file, transmitting data and attaching documents. Manual: downloading Form 135 for the requested year, filling it in, attaching certificates and submitting at the office or through public inquiries.
No. Opening a file in the online system is a technical step only, to receive the request; it does not open an active income tax file and does not change your status with the Authority.
Form 106s from all workplaces and pensions, National Insurance certificates (unemployment, reserve duty, injury), certificates of deposits to provident funds and life insurance, donation receipts, Form 161 for those who retired, certificates proving eligibility (birth, marriage, disability, eligible locality) and a bank account confirmation for the credit.
Married spouses file a joint refund request, and one of them is chosen as the "registered spouse" who represents both before the Tax Authority - a declaration of the choice is attached. Spouses living separately can file separate requests, with a declaration and certificates.
Yes. A separate request is filed for each tax year (a separate Form 135 or a separate online request) with that year's certificates. Years cannot be mixed in one request, but all years can be filed in sequence at the same time.
Someone obligated to file a report (the self-employed, people with additional income) does not submit Form 135; the refund request is included in the annual report itself, and the refund usually arrives faster - according to the statutory timetables.
Yes. Heirs can request a tax refund for a deceased person who overpaid tax. It is advisable to attach an inheritance order or probate order so the money is transferred directly to the heirs.
A request for a given tax year is accepted up to 6 years from the end of that year. In practice: a request for 2020 - until 31.12.2026; for 2021 - until 31.12.2027, and so on. There are no extensions; a year that closes is lost.
One request for several years instead of separate requests; Form 135 for the wrong year; missing certificates (mainly provident funds and donations); wrong bank account details; and choosing a registered spouse without a declaration. These mistakes cause delays or technical rejection.
It varies with the Tax Authority's workload and by right: for employees the refund is made within one year of the assessment date or two years from the end of the year the tax was paid - the later of the two; for report filers - within 90 days of receiving the report or by July 31 of the year after the tax year - the later of the two. In practice, many proper requests are handled within a few months.
07 Receiving the Money and Tracking
Yes. The refund includes indexation differentials to the CPI and interest at 4% per year, so a refund for earlier years is relatively higher than the amount that stayed with the state.
Directly to the bank account of the person requesting the refund, according to the account confirmation attached to the request. Make sure the account is active and in the requester's name (or a joint account that includes them).
Only in the current tax year: if the employer computed the tax incorrectly (for example, did not grant a due credit), you can demand the refund through the payslip - even if employment has ended, as long as the year has not ended. For previous years - only through the Tax Authority.
In an online request you can track the status in the Tax Authority's personal area. If the Authority asks for completions - it is important to respond quickly so the assessment is not delayed. I accompany the process and update on every advance.
A rejection is not the final word: check the assessment's reasoning, complete documents or correct data, and in a substantive dispute an objection can be filed through the regular track. At this stage, especially with large amounts, professional accompaniment is worth considering.
The Tax Authority operates a call center (*4954) and an anonymous eligibility simulator. For a full review of all 6 years, including finding grounds you may not have thought of - you can simply write to me on WhatsApp.
08 Betterment Tax in Brief
Betterment tax is paid by the seller of a real estate right when the sale price is higher in real terms than the purchase price. On a residential apartment the tax is 25% of the net real betterment - the difference between the prices, after indexation to the CPI and deduction of recognized expenses.
In the linear calculation: the betterment is spread evenly over all ownership years, but the tax applies only to the proportional part accrued from 1.1.2014 until the sale. The earlier the purchase - the smaller the taxable part.
Renovations that raised the apartment's value, lawyer's fees, brokerage commission, purchase tax paid at purchase, certain fees and levies - all indexed to the CPI. Keep receipts: without documentation, the expense will not be recognized.
Several exemptions exist, led by the exemption on selling a single residential apartment that meets the law's conditions, and further exemptions in certain cases. Someone who did not meet the exemption conditions (for example, owning more than one apartment) pays - and then spreading and recognized expenses are the way to reduce the charge.
Within 60 days of signing the sale contract. After the declaration to Real Estate Taxation and the self-assessment, a payment voucher is sent on the Tax Authority website. Delay brings interest, indexation and penalties.
The law requires the buyer to transfer an advance on account of the seller's betterment tax, as a percentage of the consideration, to secure collection of the tax. It is offset against the seller's final liability.
On selling a residential apartment worth more than about 4.5 million NIS, an additional surtax applies to the part of the betterment above the threshold, on top of the regular betterment tax. The threshold is updated from time to time - checked in each deal.
An apartment rented under the income tax exemption track (the 10% track) reduces the expenses recognized for deduction, and certain depreciation is added to the betterment calculation. This fact directly affects the tax amount and must be addressed before the sale.
09 Betterment Tax Refund - When You Paid Too Much
Mainly: recognized expenses not deducted in the assessment, an exemption or relief not claimed, a mistake in the self-assessment calculation, cancellation of the deal after payment, or spreading never performed at all. Each of these can justify a refund.
The Tax Authority lets you check online whether a credit balance exists for overpayment of betterment tax or purchase tax. If a balance exists - a refund request is filed in the same system. This is a simple first step we can do together.
Yes. If the assessment did not deduct recognized expenses (renovation, lawyer, brokerage etc.), you can request an assessment correction and recover the difference, subject to the legal deadlines and evidence. This is where the receipts you kept matter.
Cancelling a real estate purchase deal requires a refund of the purchase tax or betterment tax paid, through an appropriate request to the Tax Authority with the cancellation documents.
Not necessarily. Subject to the statute of limitations, you can request an assessment correction and claim the exemption or relief retroactively. The sooner the better.
A spreading refund comes from recomputing the tax across years - an explicit mechanism in the law (Section 48A(e)). An overpayment refund comes from an assessment that was too high from the start. Sometimes both tracks are combined in the same deal.
A statute of limitations applies here too, and the deadlines depend on the request type and the assessment date. Because the deadlines are complex, it is best to check as soon as the overpayment is discovered - a request filed too late may be rejected outright.
10 Betterment Tax Spreading - the Basics
A mechanism in Section 48A(e)(1) of the Real Estate Taxation Law: instead of taxing the entire betterment in the sale year, the real betterment is "spread" over up to 4 years back. In each year, its part of the betterment joins that year's taxable income, and the tax is set by that year's tax brackets and your credit points.
Betterment tax for an individual is computed at the seller's marginal tax rates on the betterment (with a maximum 25% cap for a residential apartment, subject to the rules). In a single sale year, the whole betterment may jump to the high bracket. With spreading, the parts of the betterment "fill" lower brackets in each year - and total tax drops.
Up to 4 years back from the sale year, or the ownership period of the asset - whichever is shorter. The ownership period starts in the tax year after the purchase year and ends in the sale year.
An apartment bought in 2013 and sold in 2016: the ownership period is 2014-2016, so it can be spread over only 3 years. An apartment bought in 2010 and sold in 2026: the ownership period is longer than 4 years, so the spreading is maximal - 4 years (2023-2026).
An individual who is an Israeli resident, who sold a non-exempt real estate right, and filed annual income tax reports for the years the spreading is requested for. A company or corporation is not eligible - spreading is granted to natural persons only.
The request form for betterment tax spreading. It is attached to the declaration on the sale of a real estate right, and in it you fill the taxable income at regular tax rates in each spreading year and the number of credit points in each year.
For someone whose income in part of the spreading years was relatively low: a study period, unemployment, maternity leave, opening a business or retirement. The greater the gap between the bracket in the sale year and the brackets in the spreading years - the greater the saving.
Real Estate Taxation execution instruction 4/2011 (and supplement 1 of 2019) regulates handling of a spreading request: how to file, which documents are required (including proof of filing reports under Section 131 of the Ordinance) and how the Real Estate Taxation director computes.
Spreading can also be done when selling several assets, but it is a complex matter: the betterment from all the sales spreads over the same years and affects the brackets mutually. An exact calculation is mandatory before deciding here.
When income in the spreading years was higher than the bracket in the sale year, when the betterment is small, or when reports were not filed in the spreading years and cannot be completed. In the simulation I run, both tracks are seen side by side - and if spreading loses, it is said explicitly.
11 Spreading in Special Cases
Each spouse can request spreading separately on their share, according to their own credit points and tax brackets. It was ruled (Tax Appeal 6/97) that spouses may split the betterment and spread in two separate assessments. Sometimes it pays to spread only for one spouse.
A seller who inherited the apartment can spread over the deceased's ownership period too, starting from the tax year after the deceased's purchase (Tax Decision 12/5825) - and in any case up to 4 years. This is a significant advantage with old inherited apartments.
With a gift too, the donor's ownership period can be included in the spreading (ruled in Appeals Committee (TA) 1290-09), up to 4 years. It is important to collect the donor's original purchase details - the date and price.
Yes. Sellers over 60 or with a disability are entitled to lower income tax brackets on the betterment, so spreading into years when those brackets applied significantly reduces the tax. This is one of the cases where spreading saves the most.
The spreading calculation made by the Real Estate Taxation director may not include the sale year itself, and then the tax collected is higher than the statutory tax. After filing the annual report for the sale year (which includes the real estate betterment), a complementary calculation is made and the difference is refunded.
The taxable income at regular tax rates in that year and the number of credit points you were entitled to in it. The data is taken from the reports filed or from income tax assessments - which is why filing reports for those years is a condition for spreading.
Spreading is conditional on filing reports for the spreading years. If reports were not filed, in certain cases it may be possible to complete the filing retroactively - and it may not. This is a critical point to check with the Tax Authority before promising anything.
Spreading is granted to Israeli residents. When one spouse is a foreign resident, the matter is more complex and checked individually - sometimes only the Israeli-resident spouse's share can be spread.
12 Spreading and Refunds in Practice, and Working with a CPA
Collect the assessment or Form 7000 and purchase documents; run a simulation of regular tax versus spreading; choose the worthwhile spreading years; fill in Form 7003 and attach it to the declaration with report evidence; and track the director's assessment and the refund.
The taxable income at regular tax rates (by income tax brackets) in each requested spreading year, and the number of credit points due in each year. A mistake in this data directly affects the calculation - so it is filled from the reports only.
If the tax under the spreading calculation is lower than what was paid - the difference is refunded with interest and indexation, per the law's provisions. The refund is made with Real Estate Taxation and Income Tax, sometimes only after completing the report for the sale year.
The Real Estate Taxation assessment or Form 7000; the purchase contract and purchase date (including the deceased's or donor's details, if relevant); receipts for expenses and renovations; income in the spreading years; and the number of credit points in each year. An exact list is sent after the clarification call.
Identifies the refund grounds, computes the statutory tax against the tax paid, prepares the requests and documentation, files with the Tax Authority and handles questions and completion demands until the money arrives. In spreading cases - also choosing the optimal spreading years.
The fee is set with each client in a personal conversation, according to the case type and complexity, and subject to the CPA Institute's ethics rules. You receive the offer in writing before work begins - no surprises.
Yes. As a CPA I am bound by professional confidentiality duties and the CPA Institute's rules. Case documents are used solely for handling before the Tax Authority and are not passed to any other party.
That is said at the review stage, before anything is filed. The eligibility review exists exactly for that: if the calculation shows no refund or that spreading is not worthwhile - you get a direct, clear answer, and no request is filed for nothing.
Yes. We start with a clarification call and whatever you have. Some certificates can be obtained from employers, funds and the bank, and the Tax Authority holds part of the data. We only ask you to chase what truly cannot be obtained another way.
Selling an inherited apartment, an apartment received as a gift, a sale by spouses in property separation, a sale after a rental period under the exemption track, and deal cancellation - all are cases where the calculation is not trivial and a mistake is expensive. On legal questions (wills, registration, objections) consult a lawyer practicing in the field.
